Please read these terms carefully before using PVCAD software.

1. Acceptance of Terms

By downloading, installing, or using PVCAD ("the Software"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Software. These Terms constitute a legally binding agreement between you ("User" or "Licensee") and PVCAD ("we," "us," or "Company").

2. License Grant

Subject to your compliance with these Terms and payment of applicable license fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use PVCAD solely for your internal business purposes on the number of devices specified in your purchased license plan.

3. License Types and Restrictions

PVCAD licenses are issued per seat (named user or machine) unless otherwise specified in your Enterprise agreement. A license activated on one computer may not be simultaneously used on another computer. License sharing, pooling, or concurrent use beyond the licensed seat count is strictly prohibited.

4. Intellectual Property

PVCAD and all associated intellectual property rights, including but not limited to software code, algorithms, user interface designs, documentation, and trademarks, are the exclusive property of PVCAD and its licensors. These Terms do not grant you any ownership rights in the Software.

5. Payment and Subscription

License fees are payable in advance for the license period selected. Annual licenses renew automatically unless cancelled at least 30 days before the renewal date. We reserve the right to modify pricing with 30 days' notice. Failure to pay applicable fees may result in suspension or termination of your license.

6. Software Updates

Active license holders are entitled to software updates released during their license period at no additional charge. Updates may modify or remove features at our discretion. We are not obligated to provide updates beyond the licensed period.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PVCAD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or meet your specific requirements. The output of the Software is provided for design assistance purposes and must be verified by a qualified engineer before use in any construction or submission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PVCAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability shall not exceed the license fees paid by you in the twelve months preceding the claim.

9. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach any provision of these Terms. Upon termination, you must cease all use of the Software and delete all copies from your systems. Termination does not entitle you to a refund except as provided in our Refund Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify active license holders of material changes via email or in-software notification. Continued use of the Software after such notification constitutes acceptance of the updated Terms.
